Charging someone with Grand theft because they happened to have a high limit on their visa seems to be making a mockery of the system. Basically, O'byrn is being charged with the same crime as someone who car-jacks ... pretty pathetic IMO! I couldn't agree more, but that's what happens when a 'Get Tough on Crime'/'Zero Tolerance' mentality grips frightened populations and pandering politicians looking to score cheap points by 'cracking down on crime' whether or not it makes any sense to do so. Incidentally, the Harper government is trying to nudge Canada in the very same direction via tougher rules for mandatory sentencing despite considerable evidence that sentencing has no effect on crime rates. Neech Posted February 12, 2008 Share Posted February 12, 2008 I found this story highly amusing when I found out, although I wish it could have happened with another team. O'Byrne always seemed to come across kind of like a doofus, and Kosto didn't seem like the sharpest tool in the shed either. This was just a stupid mistake they made while wasted (although in their mugshots they don't appear to be too hammered). I doubt this will have an effect on the team, and I don't see it causing serious legal problems. These are rich guys backed by a wealthy organization, they find ways to get out of serious punishment in a relatively minor case like this. The District Attorney will look at the case and pick a charge, then they will probably offer a plea down in order to avoid a trial. The whole limited travel thing is usually for repeat offenders. I actually know somebody who clerked in a Florida court and they agree. Exact words were "non-issue". She probably had a lot to do with all the false information going around. If she took it any farther and then the courts found out she was not completely honest she'd burn too. So I'll bet everyone decided it was better to leave it alone. Nobody got a big pay-out to shut -up. Not in this case anyway. I hope Ryan levels some dudes tonight just to get this all out of his system. A good team bonding moment that's for sure...... Who wants to bet that Ryan will hit someone real hard tonight......a scrum will occur, and guess who will fly in to the rescue and get beat like a goat? Or maybe he paid her for service rendered, he was less than satisfied and ripped the purse from her hands to get his money back. That's a classic Chris Chelios story... He got ripped off by a hooker and stole her purse to get his money back. I tell you, this O'Byrne story is nothing compared to what the boys would do back in the 80's. No grand conspiracy theory here, nothing outrageous, just a bad idea followed by a dumb lie to the cops and bang: it's all over the World. This is pretty typical in these cases where it is up to the victim to decide. Not sure about Kost however. Did they drop those charges too, or are they going to sweat him a little. One theory is that they were deleting pictures she took of them. Might be why they did it, but doesn't really make it right. If I get drunk in a public place and do something stupid, I am taking my chances with all the damn camera phones around. Good lesson for him however. I still suspect that there was some internal punishment for the embarrassment caused. Wonder if O'byrne is carrying the goalie's bags for the rest of the season? The ones that do not get dropped get pled down. About 1-2% of cases go to trial. This is in no way surprising. The surprising part was the degree to which Montreal reporters willfully ignored how the justice system works. Once again, this whiole story was blown up way out of proportion, and who do we have to thank for this? The Montreal Media. Apparently this wasn't even a story in Tampa!
